These Terms of Service ("Terms") govern your access to and use of our website at neilsconstruction.com, our mobile application (Neil's Construction Mobile), and the contracting, renovation, and construction services we provide (collectively, the "Services").

By accessing our website, creating an account in our mobile application, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our platforms or services.

1. Services & Estimates

Neil's Construction Inc. provides general contracting, home renovation, remodeling, masonry, roofing, and related construction services in New York and surrounding areas.

• Estimates & Quotes: Initial estimates provided via our web form or mobile application are non-binding approximations based on the information provided. Formal, binding quotes are issued following on-site assessment or formal project review and require client approval.
• Scope Changes: Any adjustments, change orders, or additions to agreed-upon work must be documented and approved through mutual written confirmation or via the mobile application chat/quote acceptance flow.

2. User Accounts & Mobile Application

When you create an account in our mobile application, you must provide accurate, complete, and current information. You are responsible for safeguarding your login credentials and for all activities that occur under your account.

• You agree not to use the app for any unauthorized or unlawful purpose.
• You agree not to submit fraudulent service requests or false information.
• You may delete your account at any time via Profile > Delete Account within the app, subject to our 3-day grace period.

3. Payments, Milestones, and Invoicing

Payments for services, deposits, and scheduled milestones are handled securely through our payment provider, Stripe.

• Payment terms, milestones, and deposit requirements are outlined in your approved project quote or work contract.
• Invoices generated in the app or sent electronically are due according to the schedule specified in the quote.
• We do not store complete payment card details; all financial transactions are securely processed by Stripe under their applicable terms.

4. Customer Responsibilities

To ensure timely completion of construction projects, clients agree to:

• Provide timely and reasonable access to the property where work is to be performed.
• Ensure necessary homeowner association (HOA) or building management permissions have been secured unless otherwise agreed upon in writing.
• Review and respond promptly to project questions, material selections, and work reports submitted through the application.

5. Intellectual Property

All content, brand assets, logos, photographs of completed works, design layouts, and software code on our website and mobile application are the exclusive property of Neil's Construction Inc. or its licensors and are protected by applicable copyright and trademark laws.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Neil's Construction Inc. shall not be liable for indirect, incidental, special, consequential, or punitive damages resulting from your use of the website or mobile application. Construction work warranties and liabilities are governed by the specific written construction contract executed for your project.

7. Termination

We reserve the right to suspend or terminate your account or access to the digital platforms if you violate these Terms or engage in conduct that harms our business, employees, or other users.

8. Governing Law

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

9. Changes to Terms

We may update these Terms from time to time. When changes are made, we will revise the "Last Updated" date at the top of this page. Your continued use of the platforms after such modifications constitutes your acceptance of the revised Terms.
